Liability capping schemes: Qld and ACT schemes approved

On Friday 7 December 2007, the Professional Standards Council approved the Institute's Queensland and Australian Capital Territory limitation of liability schemes.  
 
The schemes will now be sent for the gazettal and approval of the attorney general in each state and territory. 
 
Schemes have now been approved in every state and territory, except for Tasmania. We will continue to provide updates regarding the commencement dates for each of the schemes. 
 
State-by-state situation 
 
A summary of the current position in each state follows:

  • New South Wales: scheme commenced on 8 October 2007, prescribed by Commonwealth on 17 October 2007
  • Western Australia: scheme commenced on 8 October 2007, prescribed by Commonwealth on 17 October 2007
  • Northern Territory: scheme to commence on 8 January 2008
  • Victoria: Awaiting notice of gazettal
  • South Australia: Awaiting notice of gazettal
  • Queensland: Scheme to be sent to Attorney General for gazettal
  • Australian Capital Territory: Scheme to be sent to Attorney General for gazettal
