The Appeal Tribunal heard an appeal against the determinations and sanctions imposed by the Professional Conduct Tribunal on 3 May 2006. The Professional Conduct Tribunal had found a case established that Mr Blaze was liable to disciplinary action in accordance with: 
 
1. By-law 40(f), in that he failed to cause his trust account and trust account records to be audited:

  • (a) for the year ended 31 March 2003, in breach of paragraph 34.1 and 34.2 of Miscellaneous Professional Statement APS10; 
     
  • (b) within ninety days of 23 May 2003 when the trust account ceased to operate, in breach of paragraph 34.3 of APS10
2. By-law 40(g), in that he failed to reply to letters from the General Manager Standards & Public Affairs dated 22 December 2004 and 25 January 2005 concerning the audit of his trust account. 
 
The decisions of the Appeal Tribunal were: 
 
1. to affirm the determination of the Professional Conduct Tribunal that the allegations had been established; 
 
2. to vary the decision of the Professional Conduct Tribunal that Mr Blaze be excluded from membership to a decision that he be severely reprimanded; 
 
3. that Mr Blaze be required to pay $600 plus GST towards the costs of the appeal proceedings.
