Notification of Obligation Re: Anti-Terrorism Regulations

Obligations have been introduced with respect to the freezing of assets of persons or entities designated as terrorists. 
 
The obligation arises from the Charter of the United Nations (Anti-terrorism Measures) Regulations 2001 (“the Regulations”) and apply to anyone who hold assets or funds belonging to others. The regulations implement the financial aspects of Australia’s obligation under United Nations Security Council Resolution 1373 of 28 September 2001 (“Resolution 1373”). That Resolution was passed in response to the terrorist attacks on the United States on 11 September 2001 and the Regulations are therefore an important element in Australia’s counter-terrorism action. 
 
The first and second lists of persons and entities designated as terrorists under the Regulations were published in the Government Gazette on 21 December 2001 and came into effect on that date. These and all subsequent lists are also published on the Department of Foreign Affairs and Trade's website as they are gazetted. The address is: http://www.dfat.gov.au/icat/UNSC_financial_sanctions.html. It will be important to check this website regularly to ensure compliance with the obligations under the legislation 
 
Essentially the obligations under the Regulations are as follows: 
 
1. Any person who holds assets or funds belonging to a listed person or entity must immediately freeze those assets or funds. 
 
2. It is a criminal offence to make any assets or funds available to a listed person or entity.
