Program Description
Hot Tax Topics - Commercial debt forgiveness (CDF)
This session will cover:
- What is a debt to which the CDF rules apply
- Understanding what constitutes a debt forgiveness
- The tax implications of a debt forgiveness, including calculation of the net forgiven amount
- Common issues and traps surrounding the CDF provisions
- Recent developments.
Hot Tax Topics - GST adjustments
Aimed at an intermediate audience, this session will explore, in turn:
- Division 19: Adjustment events
- Division 21: Bad debt adjustments
- Division 129: Changes in the extent of creditable purpose
- Division 132: Supplies of things acquired without full input tax credits
- Division 134: Third party payments
- Division 135: Supplies of going concerns
- Division 137: Stock on hand on becoming registered
- Division 138: Cessation of registration.
Hot Tax Topics - Division 7A – An update
This session will cover:
- The calculation of a company’s distributable surplus
- The private use of assets owned by a company
- Other important legislative changes introduced with effect from 1 July 2009
- Trust distributions and Division 7A
- Exemptions from Division 7AThe specific anti-avoidance provisions within Division 7A
- The Commissioner’s discretion to disregard a deemed dividend or allow it to be franked.
Hot Tax Topics - Trust streaming
Aimed at an intermediate audience, this session discusses trusts and the operation of the new streaming rules, including:
- Overview of the trust streaming provisions
- Key concepts
- ‘Distributable income’ within the streaming legislation
- ‘Adjusted Division 6 percentage’ in the re-allocation process
- Practical outcomes of the streaming legislation
- Discussion of the impact of TR 2012/D1.
